ಬೆಂಗಳೂರು: ಅರ್ಹತೆ, ಹಿರಿತನ, ದಕ್ಷತೆಗಳಿದ್ದೂ ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್ ನ ನ್ಯಾಯಮೂರ್ತಿಗಳನ್ನು ದೇಶದ ಇತರೆ ಹೈಕೋರ್ಟ್ ಗಳ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿಗಳ ಹುದ್ದೆಗೆ ಪರಿಗಣಿಸುತ್ತಿಲ್ಲವೇಕೆ ಎಂದು ಪ್ರಶ್ನಿಸಿ ಬೆಂಗಳೂರು ವಕೀಲರ ಸಂಘದ ಮಾಜಿ ಅಧ್ಯಕ್ಷ ಎ.ಪಿ ರಂಗನಾಥ್ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿಗಳಿಗೆ ಪತ್ರ ಬರೆದಿದ್ದಾರೆ.
ಅಲ್ಲದೇ, ರಾಜ್ಯ ಹೈಕೋರ್ಟ್ ನ ನ್ಯಾಯಮೂರ್ತಿಗಳು ಇತರೆ ರಾಜ್ಯಗಳ ಹೈಕೋರ್ಟ್ ನ್ಯಾಯಮೂರ್ತಿಗಳಿಗಿಂತಲೂ ಹೆಚ್ಚು ಸಮರ್ಥರಿದ್ದು, ಅವರನ್ನು ಇತರೆ ಹೈಕೋರ್ಟ್ ಗಳ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿಗಳ ಹುದ್ದೆಗಳಿಗೆ ಪರಿಗಣಿಸುವಂತೆ ಸಿಜೆಐ ಡಿ.ವೈ ಚಂದ್ರಚೂಡ್ ಅವರಿಗೆ ಒತ್ತಾಯಿಸಿದ್ದಾರೆ.
ಎಪಿಆರ್ ಪತ್ರದ ಸಾರಾಂಶ: ದೇಶದ ಇತರ ಹೈಕೋರ್ಟ್ಗಳ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿ ಹುದ್ದೆಗಳಿಗೆ ನೇಮಕಾತಿ ಮಾಡುವಾಗ ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟಿನ ನ್ಯಾಯಾಧೀಶರ ಪ್ರಾತಿನಿಧ್ಯ ಕಡಿಮೆ ಇದೆ. ಈ ಕಳವಳದೊಂದಿಗೆ ನಾನು ನಿಮಗೆ ಪತ್ರ ಬರೆಯುತ್ತಿದ್ದೇನೆ. ಬೆಂಗಳೂರು ವಕೀಲರ ಸಂಘದ ಮಾಜಿ ಅಧ್ಯಕ್ಷರಾಗಿ, ನ್ಯಾಯಾಂಗ ಆಡಳಿತದಲ್ಲಿ ನ್ಯಾಯೋಚಿತ ಮತ್ತು ಸಮಾನ ಆಡಳಿತಕ್ಕಾಗಿ ಈ ವಿಷಯವನ್ನು ನಿಮ್ಮ ತುರ್ತು ಗಮನಕ್ಕೆ ತರುತ್ತಿದ್ದೇನೆ.
ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್ ಹಲವು ವರ್ಷಗಳಿಂದ ಅತ್ಯಂತ ಸಮರ್ಥ ಮತ್ತು ಅನುಭವಿ ನ್ಯಾಯಮೂರ್ತಿಗಳನ್ನು ಹೊರತಂದಿದೆ. ಅವರಲ್ಲಿ ಹಲವರು ತಮ್ಮ ಕಾನೂನು ಕುಶಾಗ್ರಮತಿ, ನ್ಯಾಯಾಂಗ ಮನೋಧರ್ಮ ಮತ್ತು ಸಂವಿಧಾನವನ್ನು ಎತ್ತಿಹಿಡಿಯುವ ಬದ್ಧತೆಯ ಮೂಲಕ ತಮ್ಮನ್ನು ತಾವು ಗುರುತಿಸಿಕೊಂಡಿದ್ದಾರೆ. ಆದರೂ, ಇತ್ತೀಚಿನ ವರ್ಷಗಳಲ್ಲಿ ಇತರ ಹೈಕೋರ್ಟ್ಗಳ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿಗಳ ನೇಮಕಾತಿ ವೇಳೆ ಕರ್ನಾಟಕದ ನ್ಯಾಯಾಧೀಶರನ್ನು ಸತತವಾಗಿ ಕಡೆಗಣಿಸಲಾಗುತ್ತಿದೆ. ಹಿರಿತನ ಮತ್ತು ಅರ್ಹತೆಗಳಲ್ಲಿ ರಾಜ್ಯದ ನ್ಯಾಯಮೂರ್ತಿಗಳು ಅತ್ಯುತ್ತಮ ಅಭ್ಯರ್ಥಿಗಳಾಗಿದ್ದರೂ ಸಹ ಅವರನ್ನು ಕಡೆಗಣಿಸಲಾಗುತ್ತಿದೆ.
ಈ ಪ್ರವೃತ್ತಿಯು ಸೂಕ್ತವಾದುದದಲ್ಲ ಮತ್ತು ಇದು ನ್ಯಾಯಾಂಗದ ಉನ್ನತ ಶ್ರೇಣಿಯಲ್ಲಿ ವೈವಿಧ್ಯತೆ ಮತ್ತು ಪ್ರಾದೇಶಿಕ ಪ್ರಾತಿನಿಧ್ಯದ ಕೊರತೆಯನ್ನು ಸೂಚಿಸುತ್ತದೆ. ಹೈಕೋರ್ಟ್ ನ ಕಾರ್ಯನಿರ್ವಹಣೆಯಲ್ಲಿ ಮುಖ್ಯ ನ್ಯಾಯಮೂರ್ತಿ ಪಾತ್ರ ಅತ್ಯಂತ ನಿರ್ಣಾಯಕವಾಗಿದೆ. ಈ ಹುದ್ದೆಗಳಿಗೆ ಕರ್ನಾಟಕದಿಂದ ಅರ್ಹ ನ್ಯಾಯಾಧೀಶರನ್ನು ನೇಮಿಸುವಲ್ಲಿ ವಿಫಲವಾದರೆ, ನ್ಯಾಯಾಂಗವು ಅವರ ಮೌಲ್ಯಯುತ ದೃಷ್ಟಿಕೋನ ಮತ್ತು ಒಳನೋಟಗಳನ್ನು ಕಳೆದುಕೊಳ್ಳಲಿದೆ.
ನ್ಯಾಯಾಂಗ ನೇಮಕಾತಿಗಳ ಪ್ರಕ್ರಿಯೆಯು ಹಿರಿತನ, ಅರ್ಹತೆ ಮತ್ತು ಪ್ರಾದೇಶಿಕ ಸಮತೋಲನದ ಪರಿಗಣನೆಗಳನ್ನು ಒಳಗೊಂಡಿರುವ ಒಂದು ಸಂಕೀರ್ಣವಾಗಿದೆ ಎಂದು ನಾನು ಅರ್ಥಮಾಡಿಕೊಂಡಿದ್ದೇನೆ. ಆದಾಗ್ಯೂ, ಈ ಸಮಸ್ಯೆಯನ್ನು ಕೂಲಂಕುಷವಾಗಿ ಪರಿಶೀಲಿಸಿ ಅಸಮತೋಲನವನ್ನು ಪರಿಹರಿಸಲು ಸೂಕ್ತ ಕ್ರಮಗಳನ್ನು ತೆಗೆದುಕೊಳ್ಳುವಂತೆ ನಾನು ಕೊಲಿಜಿಯಂನ ಮುಖ್ಯಸ್ಥರಾಗಿರುವ ತಮ್ಮನ್ನು ಒತ್ತಾಯಿಸುತ್ತೇನೆ. ಇದು ಹೆಚ್ಚು ಪಾರದರ್ಶಕ ಮತ್ತು ಅಂತರ್ಗತ ಆಯ್ಕೆ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಒಳಗೊಂಡಿರುತ್ತದೆ, ಜೊತೆಗೆ ಕರ್ನಾಟಕ ಮತ್ತು ಇತರ ಕಡಿಮೆ ಪ್ರಾತಿನಿಧ್ಯದ ಪ್ರದೇಶಗಳಿಂದ ಅರ್ಹ ಅಭ್ಯರ್ಥಿಗಳನ್ನು ಗುರುತಿಸಲು ಮತ್ತು ಉತ್ತೇಜಿಸಲು ಸಂಘಟಿತ ಪ್ರಯತ್ನವನ್ನು ಒಳಗೊಂಡಿರುತ್ತದೆ.
ನ್ಯಾಯೋಚಿತ ಮತ್ತು ಪ್ರಾತಿನಿಧಿಕ ನ್ಯಾಯಾಂಗವನ್ನು ಖಚಿತಪಡಿಸಿಕೊಳ್ಳುವುದು ಕೇವಲ ತಾತ್ವಿಕ ವಿಷಯವಲ್ಲ. ಜತೆಗೆ ಸಂಸ್ಥೆಯಲ್ಲಿ ಸಾರ್ವಜನಿಕ ನಂಬಿಕೆಯನ್ನು ಕಾಪಾಡಿಕೊಳ್ಳಲು ನಿರ್ಣಾಯಕವಾಗಿದೆ. ತಾವು ಈ ವಿಷಯದ ಬಗ್ಗೆ ಹೆಚ್ಚಿನ ಗಮನವನ್ನು ನೀಡುತ್ತೀರಿ ಮತ್ತು ಪರಿಸ್ಥಿತಿಯನ್ನು ಸರಿಪಡಿಸಲು ಅಗತ್ಯ ಕ್ರಮಗಳನ್ನು ತೆಗೆದುಕೊಳ್ಳುತ್ತೀರಿ ಎಂದು ಭಾವಿಸುತ್ತೇನೆ ಎಂದು ಎ.ಪಿ ರಂಗನಾಥ್ ಪತ್ರದಲ್ಲಿ ಒತ್ತಾಯಿಸಿದ್ದಾರೆ.

I am writing to you with concerns regarding the under-representation of judges from the Karnataka High Court in appointments to the position of Chief Justice in other High Courts across India. As a public spirited lawyer and Former President of the Advocates’ Association Bengaluru, thus being deeply invested in the fair and equitable administration of justice, I believe this issue warrants your urgent attention.
The Karnataka High Court has produced several highly capable and experienced judges over the years, many of whom have distinguished themselves through their legal acumen, judicial temperament, and commitment to upholding the Constitution. Yet, in recent years, judges from Karnataka have been consistently overlooked for Chief Justice appointments in other High Courts, even when their seniority and qualifications would make them eminently suitable candidates.
This trend is troubling, as it suggests a lack of diversity and regional representation in the higher echelons of the judiciary. The Chief Justice role is a crucial one, setting the tone and direction for the overall functioning of à High Court. By failing to appoint qualified judges from Karnataka to these positions, the judiciary risks losing the valuable perspective and insights that these individuals can bring to the table.
I understand that the process of judicial appointments is a complex one, involving considerations of seniority, merit, and regional balance. However, I would urge you, as the head of the Collegium, to closely examine this issue and take appropriate steps to address the imbalance. This could involve a more transparent and inclusive selection process, as well as a concerted effort to identify and promote deserving candidates from Karnataka and other underrepresented regions.
Ensuring a fair and representative judiciary is not only a matter of principle but also crucial for maintaining public trust in the institution. I hope you will give this matter your utmost attention and take concrete actions to rectify the situation.
